Who is the administrator of your personal data?

The administrator, i.e. the entity deciding upon how your personal data will be used, is AmStadion sp. z o.o. based in Kraków, Al. Pokoju 33, Poland (hereinafter referred to as "We" or "Company"), the operator of an online store found under www.podstadionem.pl and www.amstadion.com (hereinafter referred to as "AmStadion").

How did we acquire your data?

We received it from you when you were using AmStadion, when you registered your account, and as a result of the transactions that you have made.

What is the purpose and legal basis for AmStadion sp. z o.o. to be processing your personal data?

We process your personal data because this is required to perform the agreement that we have executed with you, i.e.:

  • allowing to make full use of AmStadion, including making transactions and payments for products purchased at AmStadion;
  • registering and managing your account;
  • executing agreements concluded as part of a sale agreement in AmStadion stores;
  • handling a complaint in the case that you file such a complaint;
  • handling submissions that you send to us (e.g. through the contact form);
  • contacting you, including for purposes related to service provision.

In addition, the provisions of the law require for us to process your personal data for taxation and accounting purposes.

We also process your personal data for the purposes given below, based on a lawful interest of AmStadion sp. z o.o., which is:

  • conducting statistical analyses;
  • conducting research and analyses of AmStadion, among others, concerning the functioning of the online store, improvement of service operations, troubleshooting errors, or assessing the main interests and needs of visitors;
  • handling your requests submitted especially via the contact form or live chat in a situation when they are not directly related with the performance of the agreement;
  • conducting studies and collecting opinions on the quality of the provided services;
  • organisation of loyalty programs;
  • ensuring the safety of services that we provide you with though electronic means;
  • storing data for archiving purposes and ensuring accountability (demonstrating our fulfilment of obligations resulting from the provisions of the law).

If you agree to this, we will process your personal data in order to:

  • conduct marketing activities in relation to you, including conducting direct marketing of AmStadion’s own services, or services or products of third parties;
  • organise contests and promotional actions in which you can participate.

You can cancel your consent for processing personal data at any moment the same way that you have agreed to it. We will process your personal data until you cancel the consent.

Do you have to provide us with your personal data?

We require you to provide the following personal data in order to be able to conclude the agreement with you and perform it, resulting in us providing you with product sale services:

  • name,
  • surname,
  • address,
  • e-mail,
  • phone number.

If, for any reason, you are unable to provide those data, we will unfortunately not be able to conclude the agreement with you, meaning that you will not be able to conclude a sale agreement with AmStadion.

If the provisions of the law require it, we may require you to provide us with other data that is essential, for example, for accounting or taxation purposes. Besides those cases, providing personal data is voluntary.

What rights do you have in relation to the Company when it comes to data processing?

We guarantee the fulfilment of all your rights resulting from the general data protection regulations, i.e. right to access, rectify or erase your data, limiting the processing of data, right to transfer the data, not being subject to automated decision-making, including profiling, as well as the right not to agree for your data to be processed.

You can exercise those rights when:

  • in relation to a request to rectify your data: you notice that your data are incorrect or incomplete;
  • in relation to a request to erase your data: your data will not be required for the purposes for which it was collected by the Company; you cancel your consent to private data processing; you file an objection for processing your data; your data is processed against the law; the data must be erased in order to fulfil an obligation resulting from the provision of the law or they were collected as a result of the provision of services via electronic means offered to a child;
  • in relation to a request to limit the processing of data: you notice that your data are incorrect – you can request to limit the processing of your data for a period allowing us to verify the correctness of the data; your data will be processed against the law, but you would not like for it to be erased; your data will no longer be of use for us, but when you might need it for defence purposes or pursuing claims; or you file an objection for data processing - until it is determined if the lawful bases on our behalf are overriding in relation to the basis of the objection;
  • in relation to a request to transfer the data: the processing of your data is conducted on the basis of your consent or an agreement concluded with you as well as when the processing is conducted automatically.

You have the right to file a complaint concerning us processing your personal data to a supervisory authority, that is the General Inspector for the Protection of Personal Data (address: Generalny Inspektor Ochrony Danych Osobowych, ul. Stawki 2, 00-193 Warszawa, Poland).

What are the situations in which you can file an objection for the processing of your personal data?

You have the right to file an objection concerning the processing of your personal data when:

  • the processing of your personal data is conducted on the basis of a lawful interest or for statistical purposes, and the objection is justified by an extraordinary situation, which you found yourself in,
  • your personal data are processed for the purposes of direct marketing, and they are profiled for this purpose.

Who do we share your personal data with?

We share your personal data with entities that support us in the provision of services via electronic means, i.e. entities that provide payment services, courier services, postal services, insurance services, entities that provide programming, consulting or auditing services, support the handling of AmStadion users, support the promotion of offers, cooperate as part of marketing campaigns. We have the right to transfer your personal data to public entities fighting frauds and abuse.

How long do we store your personal data for?

We store your personal data during the period of the agreement that we have concluded with you, as well as when the agreement is over, in order to:

  • pursue claims related to the performance of the agreement,
  • perform duties resulting from the provisions of the law, especially including those related to taxation and accounting,
  • prevent abuse and fraud,
  • for statistical and archiving purposes.

We store your personal data for marketing purposes throughout the term of the agreement or until you file an objection for such processing, depending on which of those cases occurs first.

In the case of the organisation of loyalty programs, contests and promotional actions, in which you can participate, we will process your data for the duration of those events and the period of handing out prizes. For the purpose of accountability, i.e. proving that the provisions on the processing of personal data are abided by, we will store the data for a period in which AmStadion sp. z o.o. is obliged to keep the data or documents containing the data in order to document the fulfilment of legal obligations as well as allowing for public authorities to control the fulfilment of legal obligations.

Do we transfer your data to countries outside of the European Economic Area?

Your personal data will be transferred outside of the European Economic Area to Google LCC based on appropriate legal safety, i.e. standard contractual clauses on personal data protection, approved by the European Commission.

Do we process your personal data automatically (including via profiling) in a way that impacts your rights?

Your personal data may be processed automatically (including in the form of profiling); however, this will not have any legal consequences in relation to you or similarly will not significantly impact the situation that you are in.

Profiling of personal data by AmStadion sp. z o.o. consists in the processing of your data (including in an automatic way) by using them to assess some information about you, especially for the purpose of analysis or forecast of personal preferences or interests.
